2010, Project Achieve Investment Rp 500 T

The Indonesian government projected an investment license for 2010 already reached Rp500 trillion.

"Overall 2010 was projected investment of Rp500 trillion over the already permitted. Only we see the realization, we must look toward the realization of the given permission," said Coordinating Minister for Economy, Hatta Rajasa, the office Jalan Lapangan Banteng, Jakarta, Tuesday (23 / 2 / 2010).

Interest in foreign investment into Indonesia is very high, especially Japan. Government's own target for Rp2000 trillion investment by 2014 to achieve economic growth of seven percent.

In 2009 then, the realization of investment-reach Rp160 trillion to Rp170 trillion in corporate foreign investment (FDI) and Domestic Investment (PMDN) in which the amount is relatively small due to the impact of the global crisis.

"Last year the realization of domestic and foreign investments were approximately Rp160-Rp170 trillion trillion, there have been weakening due to the crisis in the world," he said

Finance Minister Sri Mulyani : Foreign investors not to worry

Finance Minister Sri Mulyani asked the foreign investors not to worry associated with the government's plan to limit foreign ownership share in the Company's Open (Tbk).

According to him, the share of foreign ownership in a public company is still following the rules stipulated in the international rules.

"But it's like, it's no deal grand fathering of investment before the policy went into effect. Grand fathering to follow from what they got before they (foreign investors) in," he said in Jakarta last weekend.

On the other hand, he also admitted, Indonesia also needs investment in domestic policy so as not to harm the national companies.

"We also do not want us to be the capital markets are not benefit from the policy conditions," he said.

Previously, the government will review restrictions on foreign ownership through right issue at a public company. This is related to the revision of the rules of Negative Investment List (dni).

"This must be set right what if the issue of increasing opportunities of foreign stocks through right issue in the capital markets. This we still have to refer to an existing den," said Coordinating Minister for Economy, Hatta Rajasa, some time ago.

For that, the government intends to do more in-depth consultation with the Capital Market Supervisory Agency and Financial Institution (Bapepam-LK) related restrictions.

"There are proposals to her growing company, do not be limited but still provided the first opportunity to local partners to increase their capital so as not deluded by foreigners. If diluted, which means that (ownership) foreigners rises," said Hatta

Licensing Regulations Overlapping disadvantaged Business Executors

As a result of the overlapping licenses from the department of Mines and Forestry, one miner was forced to stop production activities. Closing one of the coal mines must affect the company's earnings which of course is very detrimental. This incident shows the number of licensing regulations in Indonesia are still run independently of each ministry.

PT Indo Tambangraya Megah Tbk (ITMG) was forced to close one coal mine in South Kalimantan. Mining area is fully owned by PT Jorong Barutama Greston, ITMG subsidiary, has been closed since last week.

"Closure is mainly due to the over-lapping rules, from different ministries," said Corporate Communications Manager Melina ITMG Karamoy, Friday (12/2/2010). Two rules are the rules of crossing from the Ministry of Forestry and the Ministry of Energy and Mineral Resources (ESDM).

Story, has received permission ITMG mining in the mine area from the Ministry of Energy and Mineral Resources Jorong. But alas, permission from the Ministry of Forestry has not been out. "We're still waiting for permits expansion and extension of the Ministry of Forestry," explained she.

Jorong Barutama ITMG and resignation waiting final decision from the Government. They hope this problem can be completed as soon as possible.

She said, mine closure Jorong Barutama only slightly affect the total production ITMG. "The results of Jorong mine around 1.97 million tonnes or 8.6 percent of the total production of 2010 target of 23 million tons," said Melina.

However, public exposure based on materials ITMG early January 2010 and, until September 2009 Jorong produce 2.4 million tons of coal. Until the end of 2009, Jorong expected to produce up to 3 million tons of coal. Ellipse has a total concession of land about 11,000 hectares.

Jorong addition, a mine Indomico ITMG Mandiri Bontang, East Kalimantan. The mine is estimated to produce 11.8 million tons in 2009. In addition, there are also Trubaindo Coal Mining mines in East Kalimantan with an estimated production of 5 million tons over the past year.

Besides the two mines that, ITMG Kitadin still have mine in the new operating Embalut back in mid-2009 then. During the year 2009, the mine production contribution of 0.7 million tons. Embalut mine in East Kalimantan is estimated to have average production up to 2 million tons per year.

Examples of the above cases, we see the 2 licenses from the Ministry of Energy and Mineral Resources and Ministry of Forestry. Why does not the coordination of any related permits?, Location of mines many forest areas, so that the necessary permits from the Ministry of Forestry in the use of the Forest (area, time period applies). Government needs to re-examine and analyze the licensing of any existing regulations and make improvements, so that does not happen again. Legal certainty is affecting the investment climate.

Draft Law on Religious Courts Law Division Material Marriage

Men and women should begin to think again if you want to perform marriages that are not performed in the presence of registrar of marriage or marriage and marriage siri mutah or contract. Because the perpetrators of both types of marriage can be sentenced to prison.

This was revealed in a draft Bill of Material Religious Courts Law Marriage fields listed in the National Legislation Program (Prolegnas) in 2010.

The bill contains criminal provisions (Articles 143-153), particularly related to marriage siri, mutah marriage, marriage second, third, and fourth, and without the divorce before the courts, committed adultery and denied responsibility, and marry or become a guardian of marriage , when in fact no right. The threat of punishment for criminal acts that varied from 6 months to 3 years and fines ranging from USD 6 million to Rp 12 million.

The bill also set about a mixed marriage (between two people of different nationalities). Article 142 Paragraph 3 says, prospective foreign husband must pay a security deposit to the candidate's wife through Islamic banks amounted to Rp 500 million.

In regard to the input material for the bill, Center for Development of Islamic Law and Civil Society (PPHI2M) will hold a national seminar next week. Seminar committee chairman, Abdul Gani Abdullah, professor of University Islamic State, Thursday (11/2/2010) in Jakarta, explained, the bill would be a complement to Law No. 1 Year 1974 on Marriage. Act it became a separate law to meet the further regulation of marriage in Islamic law.

Article crucial

Abdul Gani admit, there are several crucial articles in the bill, especially related to the criminal provisions. The reason is, there is the view that marriage is worship. "Worship kok punished," he said.

According to him, during this marriage under the hand often entangled with the provisions of adultery in the Book of the Law of Criminal Law (Penal Code). There are provisions in the Penal Code which states, a man or woman who have sex outside marriage is adultery illegal.

"Is that siri marriage adultery? Could not because of lawful religion. The problem is why the marriage was not recorded into the official marriage registrar. That one who? There is the view that society should be active, but others argue the government should be active. This Act will synchronize the existing realities and legal aspects, "said Abdul Gani.

He explained, the Bill needs to regulate the marriage contract was considering such a marriage is not recognized in Islamic law. Act No. 1 of 1974, he said, clearly not regulate these things. Marriage Law did not even know the rules of criminal. At that time there was the idea to load the marriage penalty provisions in the implementing regulations.

"Before the legislation was signed, the President asked for input from the clergy. When the scholars said, marriage is a religious service, but why be punished, "she said. Criminal penalties were eventually replaced by a fine of Rp 7500.

Hasbi Hassan, a religious judge who was assigned to the Supreme Court, explained, the provisions of the Marriage Law of the fine that was not relevant anymore.

100 Companies Big Tax Arrears 17.5 Trillion

DG (Directorate General) Taxation submit a list of 100 companies that owe taxes to the Parliament. A progress is, this time the list was published to the public. Perhaps it is time all should be transparent. Once-used, a list of companies that delinquent taxes are not published.

Total arrears of tax from the 100 companies amounted to 17.5 trillion rupiah, or for 33.7% of total tax arrears (both from individuals and companies) of 52 trillion rupiah The list can be seen in the chart below.

Of course publications Delinquent companies this tax, causing a reaction from them. Generally they are accused of delinquent taxes declined, but instead questioned the method of calculating the Directorate General of Taxes that are not valid, because they felt it was paid correctly (PT Sampoerna Agro, Tjiwi Kerta Chemical Factory, Garuda Indonesia, Pertamina, Jamsostek). But there is also a recognized, because it is still in dispute in the courts (Kaltim Prima Coal, owned by Bakrie Group). Semen Tonasa or who have paid taxes, but the money was not paid, and take the tax and the post office clerk, the case is in court.

For these companies this publication are made smut face, especially for companies open. Because of the negative image of the company would affect their stock price movement. Also to state-of delinquent state taxes, of course it tarnished the image of government. Because state-owned / government itself can not be examples of taxpayers who are obedient ...

But if the companies had been paid correctly, the Directorate General of Taxes to be released again the correct list. Because this would hurt the company. Should be recognized performance of our tax authorities are still far from satisfactory. Because there are rogue elements who likes tax 'playing with fire', repeating the old traditions - taxation as a 'wetland', as happened in PT Semen Tonasa.

Hopefully this problem can be quickly completed, and dead-beat dead-beat-it soon paid off. Directorate General of Taxation also adjusted-forces personnel are 'naughty'.

Indonesia Flight Future Bright

If handled carefully, accompanied by a clear vision, Indonesia's civil aviation industry has a bright future. The development shown by the national carrier Garuda Indonesia and Lion Air to be a clear sign of it. This view is presented Boeing's Senior Vice President for East Asia and Southeast Robert K Laird in a special interview with Compass and Space on the sidelines of Singapore Aerospace Exhibition, Wednesday (3 / 2) afternoon.

Laird admitted, during the last few years the crisis that makes the company go through a serious challenge. "However, entering 2010, there are some signs that make us optimistic. Air cargo began to rise, so does the number of passengers, "said Laird.

Back at the prospect of flight in Indonesia, Laird said, there are several factors at play. First, the Indonesian economy as isolated from the world economy (so as not affected, although the world economy become slow). Next, there are figures of Garuda leaders and Lion Air has a vision of aviation.

For aircraft manufacturers, like Boeing, it was very exciting because it means that aircraft orders will keep coming despite the general decline of the world order.
From Garuda and Lion, Boeing got a lot of commercial jet orders for the short and medium distances. Garuda ordered types 737-800 Next Generation, while the Lion 737-900 Extended Range ordering although the latter is also buying 747 jumbo.

Leap Garuda
In an effort to introduce programs run by the airline's lead, President Director of Garuda Indonesia Emirsyah Satar in a news conference at the Singapore Airshow arena, Wednesday afternoon yesterday, mentioning, in order to meet the surge of passengers, from 10.3 million in 2009 to 27.6 million In 2014, Garuda will increase the number of its aircraft fleet, from 56 to 116. In addition to being more fleet of Garuda in the future should be more reliable and more efficient.

Distance routes will be short with main players Garuda Boeing 737-800NG, Airbus medium range by 330-200, and for long distances by the Boeing 777-300ER. The latter will be used to support the flight to Europe and America.

Transport aircraft jet engine though, but capable of operating in this simple foundation flying cross twice. In the low-flying cross berketinggian it, visitors can clearly see the figure Globemaster developed between the 1980s for rapid deployment of this global strategic scale.

Aviation Industry Targets 15 Percent Growth

Success with passenger growth up to around 17 percent in 2009 and then, the airline business sector targeted to grow by 15 percent this year.

"Kalaui last year rising 17 percent, this year is expected to at least 15 percent. If the economic situation remains stable, the target can be achieved," Herry said in Jakarta, Wednesday (10/2/2010).

The increase in passengers, he said, will occur in addition to the improving economy also because this year the airline will add to the fleet.

He explained that if people's purchasing power increases, then the capacity also increases, then the ticket will harhga stable, leading to the increase of passengers.
In 2009 then, the number of airline passengers increased by 17 percent in the amount of 48.5 million passengers from 41.9 million in 2008.

Economy Grew 4.5 Percent, Government Gratitude

Grateful government in 2009 economic growth to reach 4.5 percent because it means so much higher than initial estimates, ie 4.3 percent. That puts Indonesia as the country that can sustain its economic growth remained positive between two other countries the same fate, namely China and India.

"We are grateful in a crisis at that time many people predicted economic growth of Indonesia just three percent, and the government itself estimates that 4.3 per cent, but was 4.5 percent," said Coordinating Minister Hatta Rajasa in Jakarta, Wednesday (10 / 2 / 2010).

According to Hatta, Indonesia became countries with economic growth in the world's third best. This was mainly caused by government spending that measured, among others, with the flow of funds into the economic stimulus, and still goes on public consumption.

"Because of low inflation, purchasing power is relatively increased. In the future this becomes a figure that we can encourage growth. However, not simply rely government budget and public spending, we also need to encourage exports and investment," he said.
